Q: I read your article last year regarding the reclassification of certain types of gaming machines and I have not yet applied to vary my current licensed premises gaming machine permit to cover the increase in permitted machines. Can I still apply or is it too late?
A: You are correct that some ‘crane grab’ style gaming machines previously identified as (SWP) machines, are now classified as Category D non-complex crane grab machines. Last year the Gambling Commission confirmed that all operators should ensure that they have the appropriate permissions in place by 31st December 2015. If you have yet to obtain the appropriate permission, any offending machines should be switched off until such time as the appropriate variation or new permission can be obtained. You can continue to make new applications but without the correct permission in place you could be providing illegal machines. If unsure of your current permission or whether an application is required you should contact your local licensing authority.
